Terms and conditions

1. Access and account

By agreeing to these Terms you represent that you are at least the age of majority in your province of residence, and that you have given consent for any minor dependents to use the Services on devices you own.

To use the Services you may be asked for your email address, identity number or passport, billing, payment and shipping information. You represent that all information you provide is correct, current and complete, and that you have the right to provide it.

You are solely responsible for keeping your account credentials safe and for all activity on your account. You may not transfer, sell, assign or license your IBO office to any other person.

2. Our products

We have made every effort to present our products accurately. Colours and appearance may differ from your screen because of device settings. We do not warrant that the appearance or quality of any product will meet your expectations or match on-screen renders.

All descriptions of products are subject to change without notice. We may discontinue any product at any time and may limit quantities offered to any person, region or jurisdiction.

3. Orders

When you place an order you are making an offer to purchase. Scentman Fragrance reserves the right to accept or decline any order. An order is not accepted until payment is received and the house confirms acceptance. Review your cart carefully before submitting — we may be unable to cancel after acceptance.

If we do not accept, change or cancel an order we will try to notify you using the email, address or phone number provided at checkout.

Retail purchases are subject to our Refund & Return Policy. Independent Business Owners buy at wholesale for lawful resale of Scentman products in the ordinary course of their IBO business. Unauthorised commercial export is not permitted.

The house will not create a paid order unless a genuine payment is confirmed by our payment provider. Draft, abandoned or unpaid checkouts are not orders.

4. Prices and billing

Prices, discounts and promotions may change without notice. The price charged is the price in effect when the order is placed and will appear on your tax invoice. Unless stated, posted prices do not include shipping, handling, customs or import charges.

Wholesale prices in the IBO office are for registered Independent Business Owners only. Retail shop prices may differ. Currency flags on this site are for display only — all invoices and card charges are in South African rand (ZAR).

You agree to keep purchase, payment and account information current so we can complete transactions and contact you.

5. Shipping and delivery

We are not liable for shipping and delivery delays. Delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by couriers, customs or events outside our control. Once products are transferred to the carrier, title and risk of loss pass to you. 6. Independent Business Owner programme

Registration as an IBO is free. Activation requires a qualifying wholesale order as published in the office. Commissions, ranks and bonuses follow the plan published on the opportunity page and may be updated prospectively.

You act as an independent contractor, not an employee, partner or agent of Scentman Fragrance. You are responsible for your own tax, POPIA compliance toward your customers, and lawful marketing.

The house may suspend or close an office that is used for fraud, spam, misrepresentation of products or ranks, or abuse of the compensation plan.

7. Intellectual property

The Services — including trademarks, brands, text, images, product reviews, video, audio and the arrangement thereof — are owned by Scentman Fragrance, its affiliates or licensors and are protected by South African and international intellectual property laws.

These Terms permit you to use the Services for your personal use and, if you are an IBO, for promoting Scentman products with house-approved marketing packs. You must not reproduce, distribute or modify house materials without prior written consent, except as expressly allowed in the office Marketing tab.

8. Optional tools and third-party links

You may be given access to tools offered by third parties (including payment, courier tracking and review platforms). We provide those tools “as is” without endorsement. Use is at your own risk. Review the third party’s terms before you engage.

The Services may contain links to websites we do not control. We are not responsible for their content, privacy or security.

9. Prohibited use

You may not use the Services to harvest personal information, attack or probe the house, the database or payment rails, upload malware, scrape at a rate that degrades the service, create false orders, or impersonate another IBO.

Automated access to member, order, payout or identity data is forbidden. We log and block abusive traffic.

10. Disclaimer, liability and indemnity

The Services are provided without warranties of any kind, express or implied, to the fullest extent permitted by South African law, including the Consumer Protection Act where it applies.

Scentman Fragrance is not liable for indirect, incidental, special or consequential damages arising from your use of the Services. Our aggregate liability for any claim relating to an order is limited to the amount you paid for that order.

You agree to indemnify Scentman Fragrance against claims arising from your misuse of the Services, your resale of products, or your breach of these Terms.

11. Governing law

These Terms are governed by the laws of the Republic of South Africa. The courts of Gauteng have exclusive jurisdiction, subject to any non-waivable consumer rights.
